			<content:encoded><![CDATA[<p>We are starting to get a lot of questions about TTB&#8217;s future. Over the years I have marveled and wondered if Bill Clinton or George W. Bush spent much time pondering the fate of ATF or TTB (and, for example, the intricacies of the label approval process). Well, the Obama Administration clearly thinks about it a lot. Late last year, <a href="http://www.winespiritsdaily.com/publications_daily.php">Wine &amp; Spirits Daily</a> <a href="http://www.winespiritsdaily.com/publications_daily.php?id=1640">wrote</a>:</p>
<blockquote><p>Obama&#8217;s Office of Management &amp; Budget (OMB) is considering &#8220;the impact of folding TTB&#8217;s tax enforcement and collection functions into IRS, to be proposed in the Budget and implemented in FY 2013,&#8221; reports Kane&#8217;s Beverage News Daily. The TTB has until Dec 28 to submit a proposal to the OMB &#8220;analyzing the feasibility and appropriateness of this proposal, including a discussion of how the missions and goals of these two agencies could be combined.&#8221; Furthermore, TTB is to review whether its &#8220;regulatory and health-safety functions&#8221; can be transferred to the IRS or even the FDA.</p></blockquote>
<p>Since then, there has been almost nothing in the press about this important story. As recently as today, Google News has <a href="https://www.google.com/search?q=omb+fda+ttb+obama+budget&amp;ie=utf-8&amp;oe=utf-8&amp;aq=t&amp;client=firefox-a&amp;rlz=1R1GGLL_en___US384#q=omb+fda+ttb+obama+budget+irs&amp;hl=en&amp;client=firefox-a&amp;hs=25m&amp;tbo=1&amp;rlz=1R1GGLL_en___US384&amp;prmdo=1&amp;prmd=imvns&amp;source=lnms&amp;tbm=nws&amp;tbs=qdr:m&amp;ei=6scuT-m8KaW20QH2h8jzCg&amp;sa=X&amp;oi=mode_link&amp;ct=mode&amp;cd=5&amp;ved=0CCUQ_AUoBA&amp;bav=on.2,or.r_gc.r_pw.,cf.osb&amp;fp=b5768f21b6260e72&amp;biw=1280&amp;bih=799">not much</a> of any consequence on this issue. I don&#8217;t see much on TTB&#8217;s website or newsletters. A few days ago, however, The Gray Report set forth some new information on this topic, and it provoked a lively discussion in the comments. W. Blake Gray <a href="http://blog.wblakegray.com/2012/02/obama-considers-huge-shakeup-in-alcohol.html">wrote</a>:</p>
<blockquote><p>The politics of this potential elimination of the TTB are fascinating, and ultimately why I don&#8217;t think it will happen even if Obama wants it. &#8230; In this climate where government austerity is seen by many as a good thing, Obama could gain some chips by trying to eliminate a federal agency. &#8230; However, the Republicans in the House seem dead-set on preventing him from achieving anything at all, and that will only intensify leading up to November. I think they&#8217;ll reflexively oppose it. &#8230; But what a conflict it poses philosophically for Republicans. Deregulation is a party tenet &#8212; but how would social conservatives react to restrictions being taken off of Demon Rum?</p></blockquote>
<p>The 2013 Federal Budget is set to be released in a week. According to <a href="http://www.washingtonpost.com/business/economy/white-house-delays-release-of-2013-budget-to-feb-13/2012/01/23/gIQA7RXYLQ_story.html"><em>The Washington Post</em></a>, &#8220;The budget is traditionally released on the first Monday in February — which is Feb. 6 — but the administration has pushed the release to Feb. 13.&#8221; Last month, Wine &amp; Spirits Daily <a href="http://www.winespiritsdaily.com/publications_daily.php?id=1648">wrote</a>:</p>
<blockquote><p>The TTB has since submitted a plan analyzing the proposal to the Office of Management &amp; Budget, but nothing is public or final at this point. &#8230; There are two current speculations as to how the reorganization would go down. One, the organization and all of its functions would be taken in one lump sum and deposited into a corner of the IRS. Two, the TTB&#8217;s tax enforcement and collection function could go to the IRS, while its regulatory and health-safety functions could go to the FDA. This is the most extreme scenario. One thing that almost everyone agreed one, however, is that an united alcohol beverage industry has enough power to squash any such proposal if it indeed made its way to Congress.</p></blockquote>
<blockquote><p>At least with the TTB the industry is the priority. With the FDA you&#8217;re with 25 or 30 other industries.&#8221; Even more problematic is that the FDA may have some anti-alcohol types, whereas the TTB is a neutral force.</p></blockquote>
<blockquote><p>One of the biggest complaints last year was the TTB&#8217;s slow response time when it came to approving labels &#8211; a result of less funding by Obama and inevitable lay-offs. As a remedy, the TTB proposed shifting its duties more towards enforcement rather than label pre-approvals, but the industry fought it. Instead, it seems the industry would rather the TTB speed up the COLA process than do away with it.</p></blockquote>
<blockquote><p>[I]t doesn&#8217;t seem likely that disbanding the TTB would save much money because theoretically it would require the same amount of people to complete the same functions now performed by the TTB, which &#8220;is pretty bare bones as it is.&#8221; Furthermore, the &#8220;TTB is one of the few revenue generating agencies in the federal government. They make a lot of money. It would be hard to split it up effectively.&#8221;</p></blockquote>
<p>Three years ago, as part of the 2010 Budget, the Obama Administration <a href="http://www.ttb.gov/newsletters/archives/2009/ttb_newsletter052209.html">flirted </a>with the idea of imposing user fees for various TTB activities, and not much came of it. In our opinion, to the extent this is some kind of business school-type exercise, or thought experiment (as in, show cause why there should not be a shakeup), it could be useful. But, if any reorganization would take several hundred people from one entity and replace them with a similar number at one or more other entities, it is hard to imagine that the costs would not outweigh the benefits.</p>

<p style="text-align: left;">Last week <em>The New York Times</em> had a good article entitled &#8220;<a href="http://www.nytimes.com/2011/12/07/dining/with-rude-names-wine-stops-minding-its-manners.html?_r=1">With Rude Names, Wine Stops Minding Its Manners</a>.&#8221; The article focused on the wide variety of <a href="http://www.bevlaw.com/bevlog/wine/bitch-wines">Bitch-themed wines</a> in the US marketplace. The article describes Royal Bitch as:</p>

<p style="text-align: left;">one of a teeming sisterhood of cabernets and chardonnays from a variety of producers with labels like Sassy Bitch, Jealous Bitch, Tasty Bitch and Sweet Bitch. They’re reinforcements for a growing army of rude, budget-priced wines that have shoved their way into wine stores and supermarkets in the past few years — most recently Happy Bitch, a Hudson Valley rosé that made its debut last month.</p>
</blockquote>
<p style="text-align: left;">The article closes by saying:</p>

<p>I was driving along and heard perhaps the perfect confluence of beer, TTB, fruit, and a multimedia extravaganza (plus history, my sister in law, etc.).</p>
<p>NPR ran a story about <a href="http://www.npr.org/blogs/thesalt/2011/09/29/140894570/the-pawpaw-foraging-for-americas-forgotten-fruit"><em>The Pawpaw: Foraging For America&#8217;s Forgotten Fruit</em></a> on September 29, 2011. The pawpaw is a creamy, mango-like fruit that grows along the banks of the Potomac River. Experts say the pawpaw is &#8220;every bit the rival of a perfect peach or apple. And these fruits have had thousands of years of breeding to make them taste good.&#8221; So good that a pawpaw newbie exclaims (<a href="http://www.npr.org/player/v2/mediaPlayer.html?action=1&amp;t=1&amp;islist=false&amp;id=140894570&amp;m=140909590">at about 3:50</a>): &#8220;Mmm, very good. Wonderful flavor. On my tongue, it says this is something new and wonderful and that I should continue it.&#8221;</p>
<p>It did not take long for a beer company to grab onto the pawpaw fervor. In discussing how the fruit plays into locavore trends and does not travel well, NPR&#8217;s Allison Aubrey talks with Garin Wright of Buckeye Brewing (<a href="http://www.npr.org/player/v2/mediaPlayer.html?action=1&amp;t=1&amp;islist=false&amp;id=140894570&amp;m=140909590">at about 6:10</a>):</p>
<blockquote><p>AUBREY: But at a pawpaw festival earlier this month in Ohio, people were showing off, at least one way of extending the pawpaw season. They make pulp from the fruit that can be canned and frozen. And even use it to make beer. Garin Wright of the Buckeye Brewing Company in Cleveland wasn&#8217;t convinced the taste of the pawpaw would come through in his brew, but it did.</p>
<p>GARIN WRIGHT: I really think that I got freshness out of that pulp that you can really smell and taste in the beer I made, so it&#8217;s awesome.</p></blockquote>

Finally, I say history because Lewis &amp; Clark, and Thomas Jefferson, were apparently big pawpaw fans according to NPR.</p>

<p>It&#8217;s not every day that you see COLA news on the front page of the newspaper, but it does happen from time to time. On Saturday, <em>The Wall Street Journal</em> featured COLA news on the front page. The story <a href="http://online.wsj.com/article/SB10001424053111904787404576529111552968274.html?mod=googlenews_wsj">explained</a> that no less than three companies have been trying to use Buffalo Bill as part of their branding &#8212; with two of them fighting it out in court. &#8220;The two entrepreneurs are fighting in court for the exclusive right to sell beer that trades on the musky aura of adventure surrounding Army-scout-turned-bison-hunter-turned-sharpshooting-showman William F. Cody.&#8221;</p>
<p>Eric Bischoff got his first COLA in March of 2011 (and the second one is <a href="http://www.bevlaw.com/bevlog/wp-content/uploads/2011/08/bb.pdf">here</a>). He is a &#8220;former professional wrestling icon.&#8221;</p>
<p>While Bischoff already has the COLAs and applied for the trademark, it looks like Mike Darby has been selling beer under the Buffalo Bill name since before Bischoff. But &#8220;Mr. Darby failed to get federal approval of his label, as required by the law. (Mr. Darby says he thought the brewer and distributor had taken care of that.)&#8221; Darby owns a hotel in Cody, Wyoming &#8220;built by Buffalo Bill in 1902.&#8221; Darby &#8220;had to pull his beer from the market&#8221; while awaiting label approval.</p>
<p>The third <a href="http://www.buffalobillsbrewery.com/bbb_about.htm">company</a> is affiliated with <a href="http://www.distilleryage.com/MDA_4_22_11_ADI.pdf">Bill Owens</a>, but is not interested in fighting over the brand name. The brewery does not even seem to claim trademark on the brand name. The story says Owens has moved on from making beer and now runs a trade group for craft distillers (&#8220;It&#8217;s much more fun to be involved with people making whiskey, vodka and absinthe, he says.&#8221;) This may allow him to avoid a roundhouse kick, a six-shooter, and the swirling lawsuits.</p>

<p>How many prognosticators, and beer companies, need to foretell the end of the world, before we see it coming?</p>
<p>The Mayans were early to call this thing, a couple of thousand years ago. But since then, Stevens Point Brewery has notably called it, with their <a href="http://www.bevlaw.com/bevlog/wp-content/uploads/2011/01/black.pdf">2012 Black Ale</a>. The label explains that &#8220;The ancient Mayans developed a &#8216;Long-Count&#8217; round calendar that ends ominously on December 21, 2012. This date is the inspiration for the name of this Ale.&#8221; Box 19 of the form explains that the date is nothing major like &#8220;a vintage date, production date, cellar date or sell-by date.&#8221; It&#8217;s only the end of the world.</p>
<p>A handful of Tequila labels back up this prophecy. The <a href="http://www.bevlaw.com/bevlog/wp-content/uploads/2011/01/luna.pdf">Luna Nueva Tequila</a> labels show a few cavorting cadavers, and refer to &#8220;2012 The Mayan Prophecy.&#8221; Box 19 of the form explains that &#8220;The ancient Mayan believed that time runs in cycles and the last recorded cycle ends on [December 21, 2012].&#8221;</p>
<p>As if that weren&#8217;t bad enough or soon enough, this Oregon brewer is getting ready with <a href="http://www.bevlaw.com/bevlog/wp-content/uploads/2011/01/apocalypse.pdf">Apocalypse IPA</a>, and this New Zealand brewer has <a href="http://www.bevlaw.com/bevlog/wp-content/uploads/2011/01/epic.pdf">Armageddon IPA</a>. Lest anyone tremble, my favorite line from the Wikipedia page is where NASA <a href="http://en.wikipedia.org/wiki/2012_phenomenon">says</a> the 2012 predictions may be comparable to those surrounding the Y2K bug.</p>

<p>Fox and <a href="http://reason.com/blog/2011/01/13/reasoner-on-stossel-nick-gille">Reason</a> have a good video about the recent brewhaha over <a href="http://www.bevlaw.com/bevlog/fmb/fda-and-ftc-banish-four-loko-and-joose">beer with caffeine</a>.</p>
<p>The video features John Stossel, Nick Gillespie, and Rhonda Kallman (owner of <a href="http://www.bevlaw.com/bevlog/wp-content/uploads/2011/01/moonshot.pdf">Moonshot</a>, Beer with Caffeine). Among the highlights:</p>
<p>Rhonda says FDA&#8217;s ban is &#8220;clearly a case of the government over-reaching. &#8230; My Moonshot Beer is nothing like these Four Loko drinks.&#8221; FDA:</p>
<blockquote><p>didn&#8217;t fully research it &#8230; they put the onus on the small entrepreneur to have a scientist. &#8230; It&#8217;s 5% alcohol by volume and less than a half a cup of coffee of natural caffeine. It&#8217;s a great combination. &#8230; They won&#8217;t stop here. Where will they stop?</p></blockquote>
<p>Sen. Schumer won&#8217;t stop at calling these drinks a &#8220;blackout in a can.&#8221; He goes further to suggest they may be a death wish in a can. And <a href="http://reason.com/blog/2011/01/14/iowa-legislator-seeks-to-crimi">here</a>, Iowa takes a step toward going much, much further (toward banning any mixture of cola, coffee or Red Bull with alcohol, at bars and restaurants).</p>
<p>Near the end of the video, Rhonda points to her <a href="http://www.moonshotbeer.com/Moonshotbeer.com/The_Petition.html">petition</a> to save Moonshot. She seeks to distinguish it from the circa-2010 Crunk, Four Loko and Joose products, and <a href="http://www.moonshotbeer.com/Moonshotbeer.com/All_Systems_Go.html">explains</a>:</p>
<blockquote><p>For the time being, Moonshot has ceased production due to [the FDA ban]. &#8230; Three of the products targeted are high alcohol, high caffeine and high sugar &#8220;juice&#8221; drinks sold in oversized 23.5 ounce cans and targeted to underage drinkers. The fourth was Moonshot ’69 – an all malt, craft-brewed pilsner beer that bears absolutely no resemblance to these high alcohol, high caffeine sugary drinks. &#8230; There is nothing new about adults combining caffeine and alcohol. Who hasn’t enjoyed a rum and Coke, Irish coffee, Kahlua or espresso martini? The question should be what levels are appropriate.</p></blockquote>

<p>The FTC handed a humongous present to Red Bull <a href="http://www.ftc.gov/opa/2010/11/alcohol.shtm">here</a>.</p>
<p>Other actions are expected imminently, as legions of other regulators rush in to <a href="http://neptune.observer.com/2010/politics/schumer-hops-four-loko-ban-wagon">exaggerate the dangers</a> (it looks like soda, it&#8217;s &#8220;loaded with caffeine,&#8221; it&#8217;s like a &#8220;plague&#8221; and &#8220;toxic&#8221;) and ignore <a href="http://www.accessdata.fda.gov/scripts/fcn/gras_notices/GRN000347.pdf">evidence</a> to the contrary. This follows many state actions in recent weeks. Presto, problem solved! We eagerly await the evidence that young people cut back on alcohol, or cut back on co-consumption of  alcohol with caffeine. We hope it&#8217;s better than the current <a href="http://www.marininstitute.org/site/images/stories/pdfs/caffeinated_cocktails_aempdf_final.pdf">leading study</a>; it purports to highlight the dangers of the pre-mixed products such as Four Loko, Liquid Charge, Joose and <a href="http://www.bevlaw.com/news-caffeine.php#caflist">scores of others</a> &#8212; without ever having examined any such products. Instead, the O&#8217;Brien study reviewed products so different they are not even within the scope of yesterday&#8217;s governmental actions (none of which, after some dexterous sleight of hand and misdirection, stopped it from instigating the above actions).</p>
<p>We believe caffeine and alcohol raise plenty of important public policy issues, whether they are combined or not, and they warrant serious deliberation. But many of the deliberations so far reflect political pressures more than an even-handed review.</p>

<p style="text-align: left;">Port Brewing LLC recently got its wit caught in a <a href="http://www.slate.com/id/2171741/">wringer</a>. The <a href="http://www.bevlaw.com/bevlog/wp-content/uploads/2010/11/ww.pdf">beer label</a> depicts a witch being burned at the stake. Various wiccans, pagans, shamans and others were not amused and <em>The New York Times</em> was there to cover it. About a week before Halloween, the <em>Times</em> article quoted an offended person <a href="http://www.nytimes.com/2010/10/23/us/23witch.html">thusly</a>:</p>
<blockquote>
<p style="text-align: left;">&#8220;Can you imagine them showing a black person being lynched or a Jewish person going to the oven?&#8221; she wrote. &#8220;Such images are simply not tolerated in our society anymore (thank the Goddess) and this one should not be, either.&#8221;</p>
</blockquote>
<p style="text-align: left;">To <span style="text-decoration: line-through;">witch</span> which the brewer responded:</p>
<blockquote>
<p style="text-align: left;">We have been accused of inspiring violence against women, and we have been compared to the violence in Darfur. &#8230; It has run the gamut from people saying politely, &#8216;This is offensive to pagans,&#8217; to people saying we are responsible for all that is wrong in the world.</p>
</blockquote>
<p style="text-align: left;">Port seems to be in the process of changing the label. Port&#8217;s co-founder said he was &#8220;&#8216;totally in favor&#8217; of changing the label and that he and his co-workers had been &#8216;ignorantly unaware of the mistake&#8217; they had made.&#8221;</p>
<p style="text-align: left;">The brewery explained that, far from being an attack on women:</p>

<p style="text-align: left;">Witch’s Wit is in a line of Catholic-themed beers, like Inferno Ale and Judgment Day, conceived in the spirit of gentle satire by Tomme Arthur, another of the brewery’s owners. Mr. Arthur says he is &#8220;a recovering Catholic.&#8221; &#8230; [The company also said it] &#8220;would really like to have some kind of contest for a great label.&#8221;</p>
</blockquote>
<p style="text-align: left;">It sounds like the system worked pretty well, without a lot of extra governmental intervention. The label got approved way back in 2008 and there was little fanfare. Eventually, a bunch of people got offended, spoke up, and Port quickly decided to change the label. <a href="http://beernews.org/2010/10/the-lost-abbey-mulls-witchs-wit-label-change-after-complaints/">Beernews</a> has a lot more good information about this controversy.
